Terms and Conditions
These terms and conditions regulate the business relationship we have with you.
By using our Website in any way, or by buying from us, including buying direct from a gallery or exhibition, you agree to be bound by them, so far as they are applicable. We reserve the right to alter and amend these Terms and Conditions without notice.
These terms and conditions comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which came into force for companies acting within UK law on 13th June 2014.
No person under the age of 18 years may purchase Goods.

The “Business” means Creu Arts & Crafts.
“Buyer” means any person or company who purchases Goods from the Business.
"Carrier" refers to anybody contracted by our artists or ourselves to deliver goods from us to you.
"Our Website" is all of the computing hardware and software that makes up our site.
"Goods" refers to anything we are selling on our website.
"Content" refers to any information on our site, published by us, or anybody else with our consent.
“Seller” means any person or business offering Artworks for sale or swap through Our Website.
2. The contract between us and you the purchaser
Goods advertised may sometimes be unavailable.
Your order will be accepted by confirmation email. The email will also confirm details of your order, and a despatch date will follow. This is when our contract with you is made. Prices may increase from those posted on our site.
Terms may change. The terms that apply to you are those here on our site on the day you place your order.
All descriptions of the goods are given by the artist, and may not be accurate. Therefore any such description does not form part of this agreement.
If any of the goods you order are unavailable you will be offered alternatives prior to us despatching your order. In this event you can:.
Accept the alternatives.
Cancel the order.
Tell us to just omit the item which is out of stock.
If you are owed money by us for this or any other reason, your debit or credit card will be credited as soon as practicable, but no later than 30 days from the order date.
Your contract is with us, and the artist, but you may not communicate under any circumstances with our artists in regard to sales, commissions, refunds or returns.

You must supply us with accurate and up to date information about yourself, to enable us to deliver your goods.
We will try to respond to any dissatisfaction you have, as long as you contact us within three months of your purchase.

The carrier will deliver to the address given in your order. Someone must be there to accept the delivery.
If we are unable to make delivery within 30 days of your order date, you will be notified by email to arrange another delivery date.
The goods may be delivered in instalments if not all the goods are available at the same time.
6. Returns and Refunds
You are buying goods by mail order, and you therefore may have a right of cancellation. If you do, the following terms apply;.
Any correspondence about the return of goods will be between you and us. The artist must not be contacted directly for any reason.
If you wish to cancel, you must inform us within 14 days of the receipt of your goods.
You may not cancel orders for specially commissioned goods.
The goods must be returned to the artist within 21 days with both goods and packaging undamaged.
The goods must be securely wrapped and include our delivery slip.
The goods are returned at your risk and cost.
When the artist receives the goods we will credit your debit or credit card with the full purchase price.
If the goods are not returned you are liable to us for the cost.
We are not obligated to collect goods from you, but if we do, you must pay the costs.
Ordered commissions cannot be returned.
We may make changes to our web site, the contents of the site, or the goods, at any time without prior notice.
Content may include technical inaccuracies.
We reserve the right to refuse any order for whatsoever reason.
We give no warranty as to;.
The adequacy of the goods for your purpose.
The truth of any information on our website.
Any implied warranty or fitness of goods for a particular purpose.
Our liability in any claim against us is limited to the value of the goods purchased.

Title and ownership rights shall remain the sole property of us/the artist.
You may not copy, reproduce, modify, or in any way exploit any of the content.
Content may be copied or downloaded only for your own personal use.
9. System Security
You agree that you will not violate any aspect of the installation’s security.
You will not modify, copy or damage any part of our web site or any software used on it.
Any such violation is unlawful, and may result in criminal prosecution.
Violation means accessing data without consent, or breaching security.
You may not attempt to interfere with service to any user.
You must not take any action to obtain goods that you are not entitled to.
10. Contractual Limitations
When goods are provided without a charge, they are not to be associated with any service for which a charge is made. There is, therefore, no obligation on us in respect of such goods.
11. Rights of third parties
Nothing in this agreement or on our web site shall confer on any third party any benefit under the provision of the Contracts (Rights of Third Parties) Act 1999.
You agree to indemnify us against any claim, including lawyers’ fees, made by a third party, arising in any way from your use of our web site, or any infringement by you, or by any other person using your computer, of any intellectual property or other right of any person.
If any of these terms is held by jurisdiction to be void, invalid or unenforceable, then it would be changed to the minimum extent necessary to bring it within the laws of that jurisdiction and will not affect any other of these terms.

We will not be liable for a breach of our obligations arising from something beyond our reasonable control, for example, strikes of our employees.

In the event of any dispute arising from these terms, or any contract between you and us, you will attempt to settle such dispute with us in a process of mediation, before commencing litigation.
If you are registered or liable to pay VAT you must abide by the VAT regulations when using our website.
If you post any Material in Our Website, you warrant that you own the copyright or are legally entitled and you accept all risk and responsibility for it. You grant to us the right to edit, copy, publish, distribute, translate and otherwise use your Material for marketing and advertising purposes.
You must not upload onto our website any artwork or offer any print for sale which infringes copyright, relevant law or regulation.
If you offer prints for sale on our website, you must be the creator, or own the copyright of the original artwork.
You may be required to provide a government issued ID or other similar identification or documentation.
You accept that any artwork or print sold or swapped through us is free from intellectual property disputes or copyright restrictions.
The copyright of the Artwork remains with the artist even after it has been sold.
17. Governing Law
This agreement shall be governed and construed in accordance with the law of England only.
In compliance with the Privacy and Electronic Communications Act we do not send random marketing emails to personal email addresses (SPAM).
Creu Arts & Crafts conforms to the requirements of the Data Protection Act, 1998.

Your order will be accepted via PayPal and/or via additional facilities (credit card). We will send you an email to confirm details of the purchase you've made and to inform you when your order will be dispatched.
Any obligations which are contractual arising from you buying the seller's work of art are not our responsibility they are the responsibility of you and the seller alone. We merely take your payment on behalf of the work's seller.
Unless it is expressly described in these terms, there is no responsibility placed on us in relation to your orders from any seller, or in relation to the works of art from any seller.
There is no guarantee that works of art shown on our website are available at all times.
You will get a complete refund if a seller does not make available a work of art which you have bought.
If you buy works of art from us in the future in an arrangement of any kind which doesn't include paying through our website, the terms set out here will still apply.
The terms set out here may change occasionally. Please note that the terms which apply to your purchase are those set out here on the day you make an order or access our website.
The account you have with us as a buyer or seller
You agree that the information you have given us about yourself is accurate, complete, and up to date. You also agree that you will continue to do this.
When you use our website, the responsibility for ensuring your account deals and password remain confidential, and the prevention of any unauthorised individual from accessing and using that account, rests with you alone.
Any activity which happens via your password and account is your responsibility and you agree to accept that. You must inform us immediately if you have reason to believe an unauthorised individual has gained access to your account without your permission. You must also immediately log into your account and change the password.
We may refuse you permission to gain access to our website we reserve that right.
You may not place any contact details in the packaging of your works of art. We do not allow direct correspondence between buyers and sellers except where there is a swap.
We retain the right to take down and cancel your account without any prior notification if you breach our terms in any way. You will remain liable for any outstanding payments to us.
Payments and prices
We reserve the right to cancel subscriptions. This can be done at any time and partial monthly terms will not be refunded.
For those registered for or who have liability to pay VAT you must conform to the regulations if you use our website.
On occasion, we may off a sale of works of art. These will be held across the whole of our website with up to 15 per cent off the sale prices displayed.
If it's required, VAT will be taken off at the point of payment if you live outside the UK.
Information we give about rates of exchange is an approximate, and rates can vary.
Our delivery terms
Works of art are normally dispatched within five working days. We email buyers a tracking number so they can follow their package's progress.
However, we cannot be liable for any delays to delivery liability rests with the seller to dispatch within the agreed timescale and with the postal services or couriers used to delivery in a timely fashion.
We are in no way liable for the postage and packaging costs of goods sent by sellers to buyers who purchase via our website. That cost rests with the seller.
Please note - it is the sellers responsibility to ensure that the items sold is correctly and safely delivered. This means that you are solely responsible for the packaging and delivery of the item sold.
It is your responsibility to properly insure your art or craft work.
Works of art are delivered to international destinations. If they are sent outside the EU, you are liable for any taxes and duties on import. We are in no way liable for these taxes and duties. Contact customs officials in your country to ensure you have the correct details. Use the details on our Contact Us page to email us if you have any questions.
Deliveries back to the artist as returns are governed by our returns policy.
We are in no way liable for damage which occurs during shipping. Damaged items may be returned to the seller for a full refund. The policies governing returns are set out in our returns policy. See advice on safe packaging here:
We are not liable for insuring your work of art. Sellers must adequately insure their items before dispatch, and buyers who are returning items must ensure they are insured adequately. Our terms are governed by our returns policy.

Only account holders who live in the UK are eligible to participate in swaps.
We hold pre-authorised payment on PayPal for the sale price of the work of art you want to swap until both of the parties complete the transaction.
We are under no obligation, contractual or otherwise, when it comes to swaps.
Any agreements for swapping are made between two holders of accounts.
Swaps are final transactions they cannot be cancelled.
Restrictions on imports, duties, and overseas taxes
The responsibility for taxes imposed in your country and duty on import is yours. Please check the information from your local customs service.
We reserve the right to improve or change our website, its content, or any of the works of art. This can be done without any advanced notice and at any time.
Our IT support team has worked hard to ensure images of the highest quality are placed on our website. However, computers show images in different formats, so we cannot offer any warranty for how correct the colours are when you view works of art on your computer.
The content on our site may include some errors in typography or inaccuracies in technical terms.
We offer no warranty and make no statements whether implied or express regarding:
Whether the works of art are adequate or appropriate to your purpose
Whether content published on our website by a third party is true
Whether the condition, fitness, or saleable qualities of the works of art are useful for a purpose except that for which they are generally used we also offer no implication of warranty for that

We are not liable for the content of any such website to which we link and we are not liable for any damage or loss which arises from you using these websites. You acknowledge and agree to this disclaimer.
We accept no liability for any loss (consequential, special, or indirect) or damages of any kind which comes from lost data, usage, revenues, or profit, which arises from or in connection to the use of our website by you or toe buying of works of art via our website. This provision applies whether this occurs as a result of a contract, or negligence, or otherwise.
If any obligation, condition, or term on our part (an implied term) is implied into our conditions legally, the liability we face is limited to the value of the services or goods you have bought ie. limited to the permitted maximum under the law.
Rights to intellectual property and content on our website
The provider of the content on our website retains the rights to intellectual property including copyright.
That includes the providers of the works of art and any other provider of content, and includes copyright of images, logos, text, icons, graphics, clips of audio, downloads of digital items, software, and data.
The compilation and designs of all of the content on our website is also a matter over which we claim a copyright. We and/or the other provider of content retain the rights of ownership and title.
You shall not publish, transfer, transmit, distribute, reproduce, perform, change, display, copy, sell, exploit in any way, or create works which are derivative from any of the content on our website ? whether in part or in whole.
You shall not use our logos, name, or trade-marks, or any content whether on your website or that of another person or business.
The material you publish
You must own the copyright of or are legally entitled to use any material you post on our website. Posting on our website means you accept any works of art sold or swapped via is free from disputes over intellectual property or restrictions on copyright.
Even after sale, the creator retains copyright of the work of art.
The security of our system
We retain the right of editing, modification, or discontinuance of our website.
We also retain the right to modify these terms without any notice.
We do not guarantee secure or uninterrupted access to our website and its operation may be disrupted or interfered with because of circumstances beyond the control of Creu.Arts & Crafts. This is acknowledged and agreed by account holders.
Even though we will do what we can to maintain our site so you can have constant access, there will be occasions when this use could be interrupted.
You will not, nor will you allow, anyone else to compromise or attempt to compromise our website's security. You agree to that.
You shall not use any kind of software tool to extract data from our website. This will be seen as a violation which is unlawful in several jurisdictions. You understand that, and understand that contravening such a law could result in a criminal prosecution.
